First of all, hi2u all, some fresh blood here
My question: how far can I go in extracting samples from - I asume - copyrighted material? I'm making a new tune (my very first one) and I've used some samples from a recently released movie trailer (which is copyrighted I'm sure), but it sounds o so badass when I use them in my tune. I'm a bit unsure of how far I can go in this though. I'm asuing it doesn't matter all that much (I've heard numerous movie samples in commercial tunes before), but if it does let me know.

im pretty sure they copywrite the "soundtrack" and you would probably need permission to release it.

well it depends on your morals really. If you dont care where your sounds come from then fuck it, sample away. Unless you are planning to release the tune on a major label, the chances of the copyrite owners actually hearing it are slim to none. I think the law also stipulates that its only classed as a breach of copyrite if your making money from it. Not sure though.
I'd personally say fuck it, if the tune really cant work without the sounds then use them. Just be sure to be truthful if questioned about the sounds. If a label did offer to release the tune you'll either have to go through numerous attempts at gaining sample clearance, or you'd have to re work to tune and remove the samples from it. Problem with this is that if the sample is absolutely intrinsic to how the tune sounds, once it is removed it might not be what the label want to release.

dont worry about it. chances are even if it did get a release its not going to be with someone whos going to press millions of copies. the odds on getting caught are fairly slim. plus just look at all the bootlegs that are floating around. pseudonyms are a fantastic thing.

Yo guys, you are getting it wrong here.
Every usage of copyrighted material is a theft (in the way of the law). Now, I believe that you can find much better use of that sample than the original author did - and that's great! I love when things are kinda buildin up on themselves.
But don't assume anything (which includes whether you will be caught or whatever).
The law is clear on this: you can use copyrighted material in this manner:
- if it is in a comic, ironic, sarcastic manner (with limited lenght),
- for your personal satisfaction, away from other people's ears, and
- for educational purposes (with limited lenght)
If you get released, do never assume you won't be caught because when you will, you will eat the dog shit to find money to pay off. If you release your tune with that sample, edit it (put effects and such stuff on it) so it is not clearly recognizable.

using movie samples is (relatively) safe. theres loads of examples.
as long as you don't go all out cutting released music and pasting entire parts into your tune, noone should even notice
