Really interesting, but there are so many other breaks out there which also seem to have entered the public domain. The think break (The one the that has Uh huh at the begining" taken from Lynn Collins' "Think about it" was written by James Brown, and I bet he's is not someone to take sampling well, yet he is reputed to be the most sampled artist ever.
If people really cracked down on sampling and copyright infrigment, it could really screw the industry as many labels would be left with huge fines for breaching the copyright law.
I think someone should find out all the equipment used for such classic breaks, get a really good drummer, record them all fresh with no vinyl crackle, and put them out into the market as copyright free samples.
It would save a lot of hastle and money.

Yeah but surly that is still infringment of copyright. I feel a challenge coming on. Im gonna try and remake this beat. Ive got a friend with some high end V-drums who is really fucking good at drumming, and I can get my hands on a nice valve desk, if I am sucsesful I'll post it on here. If anyone else is up for it, we could make it a competition and the winner gets a pat on the back and admiration from everybody ever!!!. Or maybe just a pat on the back.
Right, now I gotta find out what kinda drums they were using!?!

in fact the linked documentary mentions it at some point towards the end: the amen break has been redone and copyrighted again on some sample and drum loops cds, without paying anything to the Winstons or even crediting them. But it's not for free or course...

MMmmmm the Amen Break. I had a discussion a while ago with some DJs from Bassdrive.com (Its an internet DnB channel for all yall that didnt know) and we were just throwin ideas bcak and fourth. I respect the "Think" break as well as the "Apache" break but I dont think those have been cut down to the fullest. Ehhh....With the amen, it is a 16 beat druum sample that has thousands of combos. Not only that, but some sampling artists/djs/producers have made a whole sub genre of this one loop. It marks history not only as a powerful and popular loop, but as a sample that has spread through a lot of genres. Hip Hop was one of the first to sample it, but now the Junglists have really maximized it. I always like to screw around with the Amen beat, as im sure at least all of you producers have done at least once! RespEkt for tha drum.

this is a great link!
i have asked many "heads" about how you can go about using copyrighted samples. most say that if you make around 500 copies no one is going to care...maybe. the break is one sample i would have no fear of using. no matter what i will twist it up a bit, then its mine! my advice, make tunes all day, stop caring about who might want $ from you if it goes big. worry about it when it comes to that point. peace

Nope, the assembly line break is from a tune called "The assembly line" by the commodores. Its the one with all the blokes going HO! in it. The think break is from "Think about it" which was sung by Lynn Collins, played by the JB's, and written by James Brown. Its the one with the Uh Huh at the begining. The Uh Huh is acctually James brown. There is another classic break taken from the tune, which has Mr Brown saying something like "Do Better Man".

To-replay the amen break on your own reallife drumset would still be a copyright offence in my opinion. Just imagine that this is not about a drum break but about a cute melody (say the ABBA loop that was raped by madonna) you would not get away with that without paying big bucks for it.
If you copy note patterns from a copyrighted track without permission you are offending it's copyright. (See also:Madonna's song Frozen which violated copyright from n old song from an unknown Belgian artist).
Altough I mentioned madonna twice: I'm not a fan

man,...lol...you can play any beat you want on your own kit,.and record n chop it..if not this copyright bullshits gone too far!
