lets say a sertain person of un-known oragin
were to take a song he bought and use a wav
editor on it to cut out one instrument.

this sure as hell isnt song stealing,
but is the actualy audio protected?
is it legal or now?

(I THINK THIS IS HOW IT WORKS) but im not sure....the song itself is copywriten, and all teh intstruments, samples, vocals, etc are all a part of that copywrite...however IF and ONLY IF you use the samples in a different way than in the musci is it leagal...its not song stealing but more like idea stealling in a sense...thats why you cant use movie vocals or anything on this site, becuase you do not have the copywrites for that sample unless you are signed to an actual label and can distribute that actual music...and with that the owners of the sample will get partial profits...so the answer is yes and no...yes because you cant do it unless you have simple permission..you cant distribute as if it was your own...NO because as long as its used as promo and there is no profit or etc being made off it you can use it...(such as remixed bootlegs)

Well, I've ripped some sounds from tracks from which I knew they were just standard presets of very well known synths, so they can't be copyrighted.

I believe it is a certain number of notes or something u can copy. Copyright laws are still based on things like melodie, not sound. If u would like filter out the bassline of a song and add new drums, leads pads, etc.. u will still get in trouble because u used a part of it. If u have an official release u can pay royalty based on the sales of ur record. If on the otherhand u distribute it on the web for free, a "standard" amount will be charged even if u didn't make a dime out of it. So be carefull not to get ur song popular in a way the original producer gets ears on it.

On the other hand there are some "rarities" in legislation. Certain samples will be copyrighted, just for a single hit. Allthough it is my opinion something like that is doubtable. Example: the drummers of 2 different bands have the same set of drums. It might seem rediculus in this case to argue about who is the intelectual owner of the sound. When u make a digital sample on the other hand, ther will be discussion. Now I'll rest my case because I'm quite confusing myself.Passout

damned legal mumbo jumbo,
i heard its the work that they did to record the
instrument that they copyright, as intilectual
property. so like if you go buy the gear you own the
sounds you record.
Ford doesnt own ur ass just because you recorded
a motor sound and played it Big Grin
